UN R165 — Supplement 1 to the 00 series of amendments
Base text → Supplement 1
- What changed
- New Annex 7 gives special provisions for the testing of vehicles equipped with an ADS. The Annex says that it does not add nor remove any requirement.
- When the ADS performs the DDT, the manufacturer may design the ADS with a pause function, under the conditions given in paragraph 14.3.
- The manufacturer may now define “different available sounds” instead of “alternative sounds which can be selected by the driver” (paragraphs 6.1.3. and 14.1.5.).
- Why
- Paragraphs 6.1.3., 14.1.5. and 14.3. were revised to better reflect the functionality of vehicles controlled by a driver as well as an ADS.
- The new definitions of ADS, DDT and the sub-categories of vehicles equipped with ADS are aligned with the latest proposed R.E.3.
- New Annex 7 gives provisions for additional preparation to facilitate testing vehicles equipped with ADS for the purpose of type approval.
Q1What changed29 changes
Available sounds (paras. 6.1.3. and 14.1.5.)
Paragraph 6.1.3. is now titled “Available sounds” instead of “Alternative sounds”. In paragraph 6.1.3., the manufacturer may now define “different available sounds”; before, the text said “alternative sounds, which can be selected by the driver”. As before, each sound must be in compliance and approved with the provisions in either paragraph 6.3. or 6.4. as well as 6.5. and 6.6. Paragraph 14.1.5. now also says “different available sounds” instead of “alternative sounds which can be selected by the driver”.
Pause function when the DDT is performed by the driver or by the ADS (para. 14.3.)
The existing pause function text in paragraph 14.3. now starts with “When the DDT is performed by the driver:”. When the ADS performs the DDT, the manufacturer may design the ADS with a pause function to disable temporarily the audible reverse warning device. This applies to M2 (M>3500 kg), N2, M3 or N3 vehicles with a non-audible safety system, device(s) for means of rear visibility or detection. These must have performances at least equivalent to those described in UN Regulation No. 158, paragraph 1.3. They must allow the ADS to check the hazard area behind the vehicle, including when towing vehicle(s) of category O, and must function while reversing. In the ADS case, any other disabling function not satisfying the specifications below is prohibited, except for the specifications of paragraphs 14.3.2. and 14.3.3.
Definitions for vehicles equipped with an ADS (paras. 11.4. to 11.7.)
New paragraph 11.4. defines an “Automated Driving System (ADS)”. It is the vehicle hardware and software that are collectively capable of performing the entire Dynamic Driving Task (DDT) on a sustained basis. New paragraph 11.5. defines the DDT as the real-time operational and tactical functions required to operate the vehicle. New paragraph 11.6. defines “Category X vehicles” as vehicles of categories M, N, L and T meeting all of the following conditions. They are equipped with an ADS, are not capable of being driven manually at speeds exceeding 6 km/h, and are designed to carry occupants. New paragraph 11.7. defines “Category Y vehicles” with the same conditions (a) and (b), but they are not designed to carry occupants at any time.
New item on ADS in Annex 1B, Appendix 1 (item 0.13.)
Annex 1B, Appendix 1 has a new item 0.13.: “Vehicle equipped with ADS: …. (Yes/No)”.
Special provisions for the testing of vehicles equipped with an ADS (new Annex 7, paras. 1. and 2.1.)
New Annex 7 gives special provisions for the testing of vehicles equipped with an ADS. The Annex adapts Part II of this Regulation to vehicles equipped with an ADS, and says that it does not add nor remove any requirement. When performing the tests of this Regulation, the conditions prescribed in chapter 14 must be fulfilled. Additional preparation of the test track, the vehicle or other equipment may be needed for testing vehicles equipped with an ADS. This additional preparation must be approved by the Type Approval Authority and its designated Technical Service and described in the test report.
Single mode testing (Annex 7, para. 2.2.)
Paragraph 2.2. of Annex 7 covers vehicles equipped with an ADS, other than category X or category Y. For these vehicles, it is sufficient to test either in the manual operation or in ADS operation when the two following conditions are fulfilled. Under condition (a), the manufacturer declares that “the vehicle is designed in such a way that there should be no difference in performance regardless of manual operation or ADS operation of the vehicle with regard to this Regulation”. Under condition (b), the Type Approval Authority and its designated Technical Service agree to this single mode testing. If tested in the manual operation, the sound must be measured according to Part II. If tested in the ADS operation, the sound must be measured according to Part II, as far as applicable, and Annex 7.
Footnotes on R.E.3 and the “Low level” mode
The footnote on the Consolidated Resolution on the Construction of Vehicles (R.E.3.) now refers to document ECE/TRANS/WP.29/78/Rev.8. Before this supplement, it referred to document ECE/TRANS/WP.29/78/Rev.6, para. 2, and gave a web link. In the footnote on the “Low level” mode, the words “the driver” are removed from “would provide the driver the tool”.

Reasons
Paragraphs 6.1.3., 14.1.5. and 14.3. were revised to better reflect the functionality of vehicles controlled by a driver as well as an ADS.

“The text has been revised to better reflect the functionality of vehicles controlled by a driver as well as an ADS.”
The ADS and DDT definitions are needed to identify a vehicle of categories N and M capable of autonomously moving and navigating in traffic. The definitions of vehicle sub-categories are needed to embrace the sub-categories of vehicles equipped with ADS. Both sets of definitions are aligned with the latest proposed R.E.3.

“The new definitions necessary for identifying a vehicle of categories N and M capable of autonomously moving and navigating in traffic have been introduced.”
“The new definitions necessary for embracing the sub-categories of vehicles equipped with ADS have been introduced. They are aligned with latest proposed R.E.3.”
If a vehicle is equipped with ADS, this must be reported in accordance with Annex 1B.

“In case of a vehicle equipped with ADS, this shall be reported in accordance to Annex 1B.”
New Annex 7 gives provisions for additional preparation to facilitate testing vehicles equipped with ADS for the purpose of type approval. Annex 7 allows necessary, but minimal, adaptations that make it possible to fulfil the requirement of paragraph 14. An example is to force the vehicle to stand still during the test. These adaptations are made in agreement between the manufacturer and the Type Approval Authority and its designated Technical Service.

“Annex 7 opens for necessary, but minimal, adaptations that makes it possible to fulfil the requirement of paragraph 14 – e.g. to force the vehicle to stand still during the test – in agreement between manufacturer and Type Approval Authority”
In the footnote on the “Low level” mode, the reference to a driver was removed. This makes the provisions valid also for ADS controlled vehicles.
Source
“The reference to a driver has been removed, transforming the sentence to passive form and thus makes the provisions valid also for ADS controlled vehicles.”
