UN R116 — Supplement 4 to the 01 series of amendments

Supplement 3 → 4

Adopted at the WP.29 199th sessionEntry into force not yet known
What changed
  • New paragraphs 0. and 0.1. to 0.1.2. add an Introduction on vehicles of category X and Y and on vehicles with an ADS. New paragraphs 2.17. and 2.18. define ADSF-1 and ADSF-2.
  • For a system which locks brakes, deactivation must not automatically release the brakes unless a driver or an ADS specifically requests it (para. 5.1.2.). In paragraph 8.3.4.1., means (a) is now “at the finalisation of each ignition cycle (or run cycle, as relevant) and activation of a door”, not “at rotation of the ignition key into the "0" position in the ignition lock and activation of a door”.
  • In Annex 11, paragraphs 4.3.1. and 4.3.2. also do not apply “for vehicles of categories X and Y” or “when an ADSF-2 is activated by an authorized registered digital key”.
Why
  • Supplement 4 is introduced to take into account vehicles of category X and Y. It is also introduced to take into account vehicles with a manual mode operating at speeds above 6 km/h which are equipped with an ADS.
  • The amendment intends to extend the application of the UN Regulation to vehicles without a driver and without manual driving controls in the vehicle.

New Introduction: the purpose of Supplement 4 (paras 0. and 0.1.)

New paragraph 0. adds an Introduction to the Regulation. Paragraph 0.1. says that Supplement 4 to the 01 series of amendments is introduced to take into account vehicles of category X and Y. It is also introduced to take into account “vehicles with a manual mode operating at speeds above 6 km/h which are equipped with an Automated Driving System (ADS)”. Before this supplement, the Regulation had no paragraph 0.

Introduction
Supplement 4 to the 01 series of amendments is introduced to take into account vehicles of category X and Y, as well as vehicles with a manual mode operating at speeds above 6 km/h which are equipped with an Automated Driving System (ADS).

Vehicles without a driver and manual driving controls, and vehicles with an ADS (paras 0.1.1. and 0.1.2.)

Paragraph 0.1.1. says that the UN Regulation was originally drafted for vehicles with a driver and manual driving controls. The amendment intends to keep the spirit of the UN Regulation. It also intends to extend its application to vehicles without a driver and without manual driving controls in the vehicle. Without “driver/manual driving controls” in the vehicle, provisions related to them must not be taken into account if this amendment does not already cover them. Paragraph 0.1.2. says that, for vehicles with an ADS, no special provisions or exemptions apply in the manual driving mode. In a mode where an ADS feature is active, the relevant ADS requirements apply.

The UN Regulation was originally drafted for vehicles with driver and manual driving controls. It is the intention of this amendment to keep the spirit of the UN Regulation and to extend its application to vehicles without driver and without manual driving controls in the vehicle. In the absence of driver/manual driving controls in the vehicle, provisions related to them shall not be taken into account if not already covered by this amendment.
In case of vehicles equipped with an ADS, in the manual driving mode, no special provisions or exemptions apply. In a mode where an ADS feature is active, the relevant ADS requirements apply.

New definitions of ADSF-1 and ADSF-2 (paras 2.17. and 2.18.)

New paragraph 2.17. defines “ADS feature of type 1 (ADSF-1)” as an ADS feature which includes an ADS fallback response requiring a fallback user. New paragraph 2.18. defines “ADS feature of type 2 (ADSF-2)” as an ADS feature which does not include an ADS fallback response requiring a fallback user. Annex 11, paragraph 4.3.3. uses the term ADSF-2.

"ADS feature of type 1 (ADSF-1)" means an ADS feature which includes an ADS fallback response requiring a fallback user;
"ADS feature of type 2 (ADSF-2)" means an ADS feature which does not include an ADS fallback response requiring a fallback user.

Brake release when the device is deactivated (para. 5.1.2.)

Paragraph 5.1.2. now says: “In the case of a system which locks brakes, deactivation of the device shall not automatically release the brakes unless a driver or an ADS specifically requests to do so”. Before, the text said that deactivation must not automatically release the brakes “contrary to the driver's intention”.

In the case of a system which locks brakes, deactivation of the device shall not automatically release the brakes contrary unless a driver or an ADS specifically requests to the driver's intentiondo so.

Setting of the immobilizer (para. 8.3.4.1.)

The immobilizer must be set without supplementary action from the driver (if applicable) by at least one of the means in paragraph 8.3.4.1. The words “(if applicable)” are new. Means (a) is now the finalisation of each ignition cycle (or run cycle, as relevant) and activation of a door. Before, means (a) was rotation of the ignition key into the “0” position in the ignition lock and activation of a door. Immobilizers “which unset immediately before or during the normal starting procedure of the vehicle” are now permitted to set on “finalising the ignition cycle (or run cycle, as relevant)”. Before, they were permitted to set on turning the ignition off.

The immobilizer must be set without supplementary action from the driver (if applicable) by at least one of the following means:
at rotation the finalisation of the each ignition key into the "0" position in the ignition lock cycle (or run cycle, as relevant) and activation of a door; in addition, immobilizers which unset immediately before or during the normal starting procedure of the vehicle are permitted to set on turning , finalising the ignition offcycle (or run cycle, as relevant);

Digital keys: new cases where paragraphs 4.3.1. and 4.3.2. do not apply (Annex 11, para. 4.3.3.)

In Annex 11, paragraph 4.3.3. now lists three cases where the requirements in paragraphs 4.3.1. and 4.3.2. do not apply. The new cases are (b) for vehicles of categories X and Y, and (c) when an ADSF-2 is activated by an authorized registered digital key. Case (a), during a remote-control manoeuvring and remote-control parking as defined in UN Regulation No. 79, was already in paragraph 4.3.3.

The requirements in paragraph 4.3.1. and paragraph 4.3.2. shall not apply during a remote-control manoeuvring and remote-control parking as defined in UN Regulation No. 79.:
during a remote-control manoeuvring and remote-control parking as defined in UN Regulation No. 79;

References to R.E.3 in footnotes 1 and 4

Footnote 1 now refers to the Consolidated Resolution on the Construction of Vehicles (R.E.3.), document ECE/TRANS/WP.29/78/Rev.8, and gives a web address. Before, it referred to R.E.3, Annex 7 (document TRANS/WP.29/78/Rev.1, as amended). In the text that GRSG sent to WP.29, the footnote said “Rev.8, para. 2”. AC.1 adopted ECE/TRANS/WP.29/2026/119 as amended by Annex VI of ECE/TRANS/WP.29/1192, which gives the footnote without “para. 2”. Footnote 4 now says that the distinguishing numbers of the Contracting Parties to the 1958 Agreement are reproduced in Annex 3 to R.E.3, document ECE/TRANS/WP.29/78/Rev.8. Before, footnote 4 listed numbers for countries, from 1 for Germany to 51 for the Republic of Korea.

Q3Who is affected

Vehicle manufacturer

  • In the case of a system which locks brakes, make sure deactivation does not “automatically release the brakes unless a driver or an ADS specifically requests to do so”.
  • If you use means (a) of paragraph 8.3.4.1., make sure the immobilizer sets “without supplementary action from the driver (if applicable)” “at the finalisation of each ignition cycle (or run cycle, as relevant) and activation of a door”.
  • Check if case (b) or (c) of Annex 11, paragraph 4.3.3. takes your vehicle out of paragraphs 4.3.1. and 4.3.2.
  • For a vehicle without “driver/manual driving controls”, list the provisions related to them. Then find which of them this amendment already covers (para. 0.1.1.).

Component supplier

  • If you supply an immobilizer that sets by means (a) of paragraph 8.3.4.1., check that it sets “without supplementary action from the driver (if applicable)” “at the finalisation of each ignition cycle (or run cycle, as relevant) and activation of a door”.

Technical service / Approval authority

  • Test that means (a) of paragraph 8.3.4.1. sets the immobilizer “without supplementary action from the driver (if applicable)” “at the finalisation of each ignition cycle (or run cycle, as relevant) and activation of a door”.
  • In the case of a system which locks brakes, check that deactivation does not “automatically release the brakes unless a driver or an ADS specifically requests to do so”.
  • Before you apply Annex 11, paragraphs 4.3.1. and 4.3.2., check if case (b) or (c) of paragraph 4.3.3. applies.
  • For a vehicle without “driver/manual driving controls”, leave out the related provisions that this amendment does not already cover (para. 0.1.1.).
