UN R92 Base text (02 series) · UNECE Regulation No. 92 (ECE R92) — Uniform provisions concerning the approval of non-original replacement exhaust silencing systems (NORESS) for vehicles of categories L1, L2, L3, L4 and L5 with regard to sound emission.
UN R92 — 02 series of amendments
Changes from 01 series of amendments (supplement 2)
- What changed
- Under new paragraph 6.3.4.2., a NORESS with “different modes or variable geometries” must perform ASEP tests even where ASEP was not part of the vehicles' type approval.
- The Technical Service must perform the ASEP tests for a NORESS “equipped with multiple, manually or electronically adjustable, rider selectable operating modes or with variable geometries”.
- Paragraphs 12.2. and 12.3. limit approvals from 12 months, and extensions from 24 months, after entry into force to types that meet the 02 series.
- Why
- Some older vehicles with NORESS with “flexibilities” produce low sound pressure levels only during the Annex 3 measurement conditions.
- Outside these conditions, such NORESS often use a by-pass to the main silencer to produce much higher sound pressure levels.
- In the future, each NORESS with “flexibilities” has to meet the ASEP requirements of UN Regulation No. 41.
Q1What changed95 changes
Which NORESS must meet the ASEP requirements (paras. 6.3.4.1. and 6.3.4.2.)
Under paragraph 6.3.4.1., the ASEP requirements also apply to a NORESS for vehicles where ASEP was part of the issued type approval. Before, this paragraph named paragraph 6.3. of the 04 series of amendments to Regulation No. 41. If ASEP has to be tested, the tests and pre-tests follow the series of amendments that was the basis for the vehicle's type approval. Under new paragraph 6.3.4.2., a NORESS with “different modes or variable geometries” must also perform the ASEP tests of UN Regulation No. 41. This applies to vehicles type approved to a series of amendments to UN Regulation No. 41 where ASEP was “not a part of the issued type approval of these vehicles”. These tests follow “the actual series of amendments of the UN Regulation No. 41, which is the actual base for issuing type approvals of these vehicles”.
Back-to-back ASEP tests, test vehicle and who tests (paras. 6.3.4.3. to 6.3.4.6.)
Under typical on-road driving conditions “which are different from those under which the type-approval test set out in Annex 3 and Annex 7 of UN Regulation No. 41 were carried out”, the sound emission of the NORESS equipped vehicle must not deviate from the test result in a significant manner. Under paragraph 6.3.4.3., the ASEP tests regarding 6.3.4.2. are a back-to-back test on a vehicle with the original exhaust silencer and with the NORESS. During these tests, for each test condition, the NORESS sound-pressure level may at most equal the level with the original silencer in its approved mode. Under paragraph 6.3.4.4., tests regarding 6.3.4.1. or 6.3.4.2. of a NORESS “without multiple, manually or electronically adjustable, rider selectable operating modes or without variable geometries” must use “the vehicle as described in paragraph 3.3. (c)”. For ASEP tests of a NORESS “equipped with multiple, manually or electronically adjustable, rider selectable operating modes or with variable geometries”, paragraph 6.3.4.5. requires “each vehicle type of the range of approval application of the NORESS” to be tested in each selectable mode of the vehicle and the NORESS. The NORESS manufacturer can do the ASEP tests regarding 6.3.4.4., but the Technical Service must perform the ASEP tests regarding 6.3.4.5.
Software check and additional documentation (paras. 6.3.4.7. and 6.3.4.9.)
Under paragraph 6.3.4.7., the Type Approval Authority may require any relevant test to check that the NORESS complies with paragraphs 6.3.4.1. to 6.3.4.6. During these tests, it can also check the software of the steering units of a NORESS “equipped with multiple, electronically adjustable, rider selectable operating modes or with variable geometries”. For a NORESS “equipped with multiple, manually or electronically adjustable, rider selectable operating modes or with variable geometries”, the manufacturer must send the approval authority an additional document under paragraph 6.3.4.9. The documentation has two parts: a “formal additional documentation package” that may be made available to interested parties upon request, and an “extended additional documentation package” that must remain strictly confidential. The extended package must include information on the operation of all ASES and BSES, and all modes of operation. The Type Approval Authority retains the extended documentation package.
Transitional provisions for the 02 series (paras. 12.1. to 12.4.)
From the entry into force of the 02 series, no Contracting Party applying this UN Regulation may refuse to grant or accept approvals under it. From 12 months after the date of entry into force, Contracting Parties grant approvals only to types that meet the 02 series requirements. From 24 months after that date, they grant extensions to existing approvals only to types that meet the 02 series requirements. Even after the 02 series enters into force, approvals to the preceding series remain valid, and Contracting Parties must continue to accept them.
Statement of compliance with ASEP (para. 6.3.4.8., Annex 4)
Under paragraph 6.3.4.8., the manufacturer must give the Annex 4 statement in addition to the test report of the Technical Service. The statement is now required for NORESS “with multiple, manually or electronically adjustable, rider selectable operating modes or variable geometries”. Case (b) covers NORESS without these modes or geometries, for L3 category vehicles subject to the ASEP requirements of UN Regulation No. 41. Before, it covered NORESS for L3 category vehicles subject to paragraph 6.3 of the 04 series of amendments to UN Regulation No. 41. The manufacturer now attests compliance with the applicable ASEP requirements of UN Regulation No. 41 during the type approval procedure and its production. New footnotes ask to delete the bullet point that does not apply and to fill in the UN Regulation No. 41 series of amendments.
Approval mark example and communication form (Annexes 1 and 2)
Annex 2 gives an example of the approval mark, and its approval number is now 022439 instead of 012439. The first two digits, 02, indicate an approval granted in accordance with the requirements of this current UN Regulation No. 92. Items 8, 21 and 25 now say “motor cycle” instead of “the vehicle” for the gears used in the test in motion and the approval mark position. The Part A and Part B headings no longer start with “For”, and Part B now says “UN Regulations Nos. 9 or 63”. Other changes are a lower-case “concerning” in two places and one deleted line “Communication”.
Wording, references and punctuation (para. 6.4.3. and other paragraphs)
In many paragraphs, “this Regulation” now reads “this UN Regulation”. References to several UN Regulations now read “UN Regulations Nos.” instead of “UN Regulation Nos.”. Paragraph 6.4.3. now refers to paragraph 6.4.1. or 6.4.2. instead of 6.4.4.1. or 6.4.4.2. for measuring the output curve. In several lists, items now end with commas instead of semicolons. In the synthetic condensate composition, items (i) to (iii) no longer end with a semicolon or a full stop. Footnotes that cite the Consolidated Resolution (R.E.3) now give ECE/TRANS/WP.29/78/Rev.6 without a web address.
Q2Why it changed

Reasons
Many NORESS are designed for older L-category vehicles that are not type approved to the actual series of amendments to UN Regulation No. 41. For this reason, NORESS for these vehicles have not been tested in respect of ASEP. Some of these NORESS have multiple, manually or electronically adjustable, rider selectable operating modes or variable geometries (NORESS with “flexibilities”).

“A lot of NORESS are designed for older L-category vehicles which are not type approved according to the actual series of amendments to UN Regulation No. 41”
“Because of that, NORESS for these vehicles have not been tested in respect of ASEP.”
“Some of these NORESS use the technique of multiple, manually or electronically adjustable, rider selectable operating modes or variable geometries (NORESS with “flexibilities”).”
On some older vehicles, NORESS with “flexibilities” produce low sound pressure levels only during the Annex 3 measurement conditions. Outside these conditions, they often use a by-pass to the main silencer to produce much higher sound pressure levels. These NORESS with “flexibilities” extremely annoy people.

“Some of these “older vehicles” equipped with such NORESS with “flexibilities” produce low sound pressure levels only during the measurement conditions of Annex 3”
“Outside of these Annex 3 condition these approved NORESS with “flexibilities” often use a by-pass to the main-silencer to produce much higher sound pressure levels.”
“These NORESS with “flexibilities” extremely annoy people.”
In the future, each NORESS with “flexibilities” has to meet the ASEP requirements of UN Regulation No. 41. Paragraph 6.3.4.2. requires this even if the L-category vehicle was not tested in accordance with ASEP. The last indent of paragraph 6.3.4.2. takes the last sentence of paragraph 6.2.3. of the 03 series of amendments to UN Regulation No. 51. NORESS of L-category vehicles have the same need for this as, for example, passenger cars.

“In the future, each NORESS with “flexibilities” has to fulfill the ASEP requirements set out in UN Regulation No. 41.”
“Paragraph 6.3.4.2. requires that NORESS with “flexibilities” (different modes or variable geometries) have to fulfil the ASEP requirements of UN Regulation No. 41, even if the L-category vehicle was not tested in accordance with ASEP.”
“In the last indent of paragraph 6.3.4.2, the last sentence of paragraph 6.2.3. of the 03 series of amendments to UN Regulation No. 51 was inserted, because there is the same need for NORESS of L-category vehicles”
“the same need for NORESS of L-category vehicles like for e.g. passenger cars”
For a NORESS without “flexibilities”, the manufacturer can still do the ASEP tests. For a NORESS with “flexibilities”, the Technical Service has to do the ASEP tests. Type approval authorities can also check the software of NORESS with “flexibilities”. For these NORESS, the manufacturer has to deliver additional documentation to the approval authority.

“Paragraph 6.3.4.6. points out that the ASEP-tests can be done by the manufacturer, if it is a NORESS without “flexibilities” (unchanged procedure).”
“If it is a NORESS with “flexibilities”, the ASEP tests has to be done by the Technical Service.”
“Paragraph 6.3.4.7. adds the possibility of type approval authorities to check also the software of NORESS with “flexibilities”.”
“describe the additional documentation of NORESS with “flexibilities”, which the manufacturer has to deliver to the approval authority.”
A clarification in paragraph 6.3.4.1. gives the series of amendments to use for the NORESS ASEP test if UN Regulation No. 41 changes.
