Electromechanical and electronic devices (para. 5.3.)

Electromechanical and electronic devices to prevent unauthorized use must comply with paragraphs 5.1. and 5.2. and be submitted to the Annex 6 tests, mutatis mutandi. Before, these devices had to be submitted to the tests described in Annex 6. Components that are not embedded in the vehicle, for example keys used for activation/deactivation, need not comply with the requirements described in Annex 6. When the device technology makes Paragraph 5. and Annex 6 not applicable, it must be checked that care was taken to preserve vehicle safety. The functioning process of these devices must incorporate secure means to prevent any risk of blocking or accidental malfunctioning which could compromise vehicle safety.

Electromechanical and electronic devices to prevent unauthorized use shall comply with the requirements of paragraphs 5.1. and 5.2. and shall be submitted to the tests described in Annex 6, mutatis mutandi.
Components that are not embedded in the vehicle (e.g. keys, which are used for activation/deactivation) need not to comply with the requirements described in Annex 6.

Modification of a vehicle or component type (paras 6.1., 6.1.1. and 6.1.2.)

Every modification of a vehicle or component type with regard to this Regulation must be notified to the administrative department which approved the type. Before, modifications had to be notified to the Type Approval Authority which approved the vehicle or component type. Paragraph 6.1.1. lets the department consider that the modifications are unlikely to have an appreciable adverse effect and that the component or vehicle still complies. Or, under paragraph 6.1.2., it may require a further report from the technical service responsible for conducting the tests. The earlier paragraphs 6.1.1. on a “revision” and 6.1.2. on an “extension” are deleted.

Every modification of the a vehicle type or component type with regard to this Regulation shall be notified to the Type Approval Authority administrative department which approved the vehicle or component type. The Type Approval Authority shall department may then either:
consider that the modifications made are unlikely to have an appreciable adverse effect and that in any case the component or the vehicle still complies with the requirements, or

Communication of an extension (para. 6.3.)

Paragraph 6.3. now says the Type Approval Authority must inform the other Contracting Parties of the extension with the communication form in Annex 1. It must assign a serial number to each extension, to be known as the extension number. Before, the Authority issuing the extension of approval had to assign a serial number to each communication form drawn up for such an extension.

The Type Approval Authority shall inform the other Contracting Parties of the extension by means of the communication form which appears in Annex 1 to this Regulation. It shall assign a serial number to each extension, to be known as the extension number.
The Type Approval Authority issuing the extension of approval shall assign a serial number to each communication form drawn up for such an extension.

Reasons

  • The proposal was made to complement the text with the missing Supplement 7 to the original version of UN Regulation No. 116.

  • For paragraph 5.3., the proposal aligns the text of UN Regulation No. 161 to the content of UN Regulation No. 116 including Supplement 7. It adds “mutatis mutandi” to avoid non-applicable test conditions. It adds the last subparagraph for the case where requirements are not applicable to this specific technology.

  • For paragraphs 6.1. to 6.3., the alignment of paragraph 9 was lost during the split of UN Regulation No. 116. A new text was created. The new wording is copied from the wording adopted for paragraph 7 in UN Regulation No. 160. It is aligned with Schedule 3 of the 58 Agreement.
