UN R90 — Supplement 12 to the 02 series of amendments

Supplement 11 → 12

Adopted at the WP.29 197th sessionEntry into force 2026-06-04
What changed
  • Annex 1A has a new item 8.3. for a description of the burnishing procedure used during the type approval tests.
  • Item 1. of Annex 1A now reads “If applicable, name and address of manufacturer's representative” instead of “Applicant’s name and address”.
  • Paragraph 4.8. is deleted. It said that a Unique Identifier (UI) described in Schedule 5 to the 1958 Agreement may not replace the approval markings required by this Regulation.
Why
  • The bedding procedure in UN Regulation No. 90 has a lot of flexibility. The relevant authority or technical service does not know which bedding procedure was used for the type approval tests.
  • The terms “applicant” and “manufacturer” on the communication form differ from those used in most other UN Regulations.
  • WP.29 adopted a proposal in March 2025 that puts the implementation of the Unique Identifier (UI) marking on hold.

Q2Why it changed

Proposed by
Expert from the United Kingdom of Great Britain and Northern Ireland (Annex 1A); expert from the Netherlands (paragraph 4.8.)
Working party
GRVA, 22nd session (June 2025)

Reasons

  • Market surveillance activities by the United Kingdom of Great Britain and Northern Ireland and others identified many compliance issues with replacement brake linings. The bedding procedure described in UN Regulation No. 90 has a lot of flexibility, and this leads to inconsistent test results.

“Market surveillance activities by United Kingdom of Great Britain and Northern Ireland and others have identified many compliance issues with replacement brake linings.”
“The bedding procedure described in UN Regulation No. 90 has a lot of flexibility, leading to inconsistent test results.”
  • This flexibility leads to problems for market surveillance. The relevant authority or technical service does not know the bedding procedure used for the type approval tests. A test failure due to insufficient bedding may also mask genuine conformity issues with the product.

    Sources (2)
“The significant flexibility within the bedding procedure requirements leads to problems for market surveillance, because the relevant authority / technical service does not know the bedding procedure which was used for the type approval tests.”
“A test failure due to insufficient bedding may also mask genuine conformity issues with the product.”
  • The proposal requires the actual burnishing procedure used during type approval testing to be described on the communication form. The proposal says that relevant authorities will have access to the necessary information for independent market surveillance activities or Conformity of Production tests.

“This proposal requires the actual burnishing procedure used during type approval testing to be described on the communication form.”
“This will ensure that relevant authorities have access to the necessary information to carry out independent market surveillance activities or Conformity of Production tests.”
  • The terms for the responsible entities on the UN Regulation No. 90 communication form (“applicant” and “manufacturer”) differ from those in most other UN Regulations. The proposal aims to align them with the terms in other UN Regulations and in Schedule 3 of the 1958 Agreement (“manufacturer” and “manufacturer’s representative”).

  • In March 2025, WP.29 adopted document ECE/TRANS/WP.29/2025/17. It puts the implementation of the Unique Identifier (UI) marking on hold by amending Schedule 5 of the 1958 Agreement. Due to this amendment, the IWG on IWVTA considered amendments to UN Regulations necessary to delete all UI references. The UI concept was not yet implemented into the DETA database, so UI markings could also not have been applied yet.
