UN R95 — Supplement 1 to the 05 series of amendments

Base text → Supplement 1

Adopted at the WP.29 184th sessionEntry into force 2022-01-07
What changed
  • From 1 September 2023, Contracting Parties are not obliged to accept type-approvals of vehicles to the preceding series first issued after that date (para. 11.2.).
  • Before, paragraph 11.2. covered approvals of vehicles having an electric power train operating on high voltage.
  • Type-approvals to the preceding series first issued before 1 September 2023 must stay accepted if those series’ transitional provisions foresee this (para. 11.3.).
Why
  • The 05 series changes to technical requirements do not affect the specification of non-electrified vehicles. So the transitional provisions need not differ for electrified and non-electrified vehicles.
  • The 05 series aimed to align the requirements with UN GTR No. 20, with limited safety improvements. So approvals granted before 1 September 2023 should remain acceptable.
  • The phrase “provided the transitional provisions …” in paragraph 11.3. is added to make clear that the possibilities given in earlier series are still valid.

Q1What changed2 changes

Approvals to the preceding series first issued after 1 September 2023 (para. 11.2.)

As from 1 September 2023, Contracting Parties applying this Regulation are not obliged to accept certain type-approvals of vehicles. These are type-approvals according to the preceding series of amendments, first issued after 1 September 2023. Before this supplement, the paragraph covered type-approvals of vehicles having an electric power train operating on high voltage.

As from 1 September 2023, Contracting Parties applying this Regulation shall not be obliged to accept type-approvals of vehicles having an electric power train operating on high voltage according to the preceding series of amendments, first issued after 1 September 2023.

Approvals to the preceding series first issued before 1 September 2023 (para. 11.3.)

Contracting Parties applying this Regulation must continue to accept type-approvals of vehicles according to the preceding series of amendments first issued before 1 September 2023. This applies provided the transitional provisions in these respective previous series of amendments foresee this possibility. Before this supplement, the paragraph covered type-approvals of vehicles not having an electric power train operating on high voltage according to the 04 series. It also covered type-approvals issued according to the preceding series, for vehicles not affected by the changes introduced by the 04 series.

Contracting Parties applying this Regulation shall continue to accept type-approvals of vehicles not having an electric power train operating on high voltage according to the 04 series of amendments to this Regulation or type-approvals issued according to the preceding series of amendments to this Regulation, for first issued before 1 September 2023, provided the vehicles which are not affected by the changes introduced by the 04 transitional provisions in these respective previous series of amendments foresee this possibility.

Q2Why it changed

Proposed by
Expert from the International Organization of Motor Vehicle Manufacturers
Working party
GRSP, 68th session (December 2020)

Reasons

  • Paragraph 11.2.: The technical requirements that the 05 series of amendments changed do not affect the specification of non-electrified vehicles. So it is a simple administrative process to approve new models of these vehicles to the 05 series. Therefore, the transitional provisions need not differ for electrified and non-electrified vehicles, and the standardized provisions of the general guideline (ECE/TRANS/WP.29/1044/Rev.2) can be used.

“Since the technical requirements modified by the 05 series of amendments do not affect the specification of non-Electrified Vehicles (EV), it is a simple administrative process to obtain approval of new models of non-EV to these latest (05) series.”
“Therefore, there is no need to differentiate the transitional provisions for electrified vehicles and non-electrified vehicles and the standardized provisions given in the general guideline (ECE/TRANS/WP.29/1044/Rev.2) can be used.”
  • Paragraph 11.3.: The objective of the 05 series was to align the technical requirements with UN GTR No. 20, with limited safety improvements. Therefore, the approvals granted before Date (b), 1 September 2023, should remain acceptable.

“The objective of this series of amendments was to align the technical requirements of the UN Regulation with those of the UN GTR No. 20, with limited safety improvements.”
“Therefore, the approvals granted before Date (b) – 1 September 2023 should remain acceptable.”
  • The proposed paragraph 11.3. is, in principle, in accordance with the standardized provision V.8 of the general guideline. But in the English version, it is not clear whether “the preceding series” is singular or plural. With the understanding that it should mean “any of the preceding series”, the phrase “provided the transitional provisions …” is added. The aim is to make clear that the possibilities given in such earlier series of amendments are still valid.

“However, it is not clear whether "the preceding series" is singular or plural in its English version.”
“the additional phrase "provided the transitional provisions …" is supplemented in order to clarify that the possibilities given in such earlier series of amendments are still valid.”
  • OICA suggests keeping the wording agreed for UN Regulation No. 94 for consistency reasons. The proposal says that it is not strictly applicable to UN Regulation No. 95, 04 series of amendments.
